Terms of Service

1. Acceptance of Terms

By accessing or using ListerRank (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms apply to all visitors, users, and subscribers.

2. Description of Service

ListerRank provides SEO and listing optimization tools for marketplace sellers, including but not limited to Etsy, Amazon, eBay, and TikTok Shop. We offer both free tools and a paid “Elite” subscription plan with advanced features such as bulk generation, rank tracking, competitor analysis, and AI-powered content creation.

3. Accounts and Registration

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when registering.

You may sign in using Google OAuth. By doing so, you authorize us to access the basic profile information provided by Google (name, email, profile picture) in accordance with our Privacy Policy.

4. Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to scrape, hack, or reverse-engineer the Service
• Circumvent rate limits, bot protection, or access controls
• Submit content that infringes on intellectual property rights
• Use automated scripts or bots to access free tools beyond reasonable personal or business use
• Resell, redistribute, or commercially exploit access to the Service without written permission

We reserve the right to suspend or terminate accounts that violate these rules.

5. Free Tools

Our free tools are provided “as is” without warranty. We may impose reasonable usage limits (such as daily request caps) to ensure service quality for all users. Free tools may be modified, limited, or discontinued at any time without notice.

6. Elite Subscriptions

6.1 Billing

Elite subscriptions are billed monthly through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

6.2 Cancellation

You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months unless required by law.

6.3 Trial Period

We may offer a 14-day free trial for new Elite subscribers. If you do not cancel before the trial ends, your subscription will automatically convert to a paid plan and you will be charged.

6.4 Usage Limits

Elite plans include monthly usage quotas (e.g., bulk generation rows, competitor analyses, keyword tracking slots). Unused quotas do not roll over to the next billing period.

7. Intellectual Property

All content, software, and materials provided through the Service are owned by ListerRank or our licensors and are protected by copyright and other intellectual property laws. You retain ownership of any original content you submit to the Service (such as product descriptions or listing URLs), but you grant us a limited license to process that content solely for the purpose of providing the Service to you.

AI-generated content (titles, descriptions, tags, etc.) is provided for your use in your own marketplace listings. You may use this content commercially, but we do not guarantee that it is free from similarity to existing content.

8. Disclaimers

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. ListerRank MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that our tools will result in increased sales, higher search rankings, or any specific business outcome. Marketplace algorithms change frequently, and results may vary.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ListerRank SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

10. Third-Party Services

ListerRank is an independent tool and is not affiliated with, endorsed by, or sponsored by Etsy, Amazon, eBay, TikTok, Google, or any other marketplace platform. You are responsible for complying with each platform's terms of service when using our generated content.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service immediately ceases.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Hungary, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Budapest, Hungary.

13. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes via email or by posting a notice on the Service. Continued use of the Service after changes constitutes acceptance of the revised Terms.
